The above link is a regional San Francisco Bay Area news story about a licensed
psychiatrist who molested a bunch of young boys he was "counseling" for sexual
abuse. The whole thing seems surreal, especially since he was the former head
of the oh-so-fucking-prestigious "American Academy of Child and Adolescent
Psychiatry" that decrees how America>s youth should properly think and behave.
What baffles me is how this case can be successfully prosecuted, given that the
defendant is a licensed clinical psychiatrist who has the legal authority to
declare people insane and have them involuntarily incarcerated in a state mental
hygiene facility. In this case, Dr. Phil could declare the boys as suffering
from paranoid delusions or perhaps "factual disorder" and avoid trial completely,
or he could declare one or more jurors "unstable" and have them removed and
thus cause a mistrial, or he could even declare that he believes the judge might
be suicidal and have him hauled off in a straightjacket for observation in a
mental hygiene facility.
So why can>t this happen? AFAIK, he has not lost his license and presumably his
professional opinion is exactly as valid as any other psychiatrist>s. And since
psychiatrists have the legal authority to define what is mentally correct and
to order innocent people to be locked up against their will, that means he has
the power to declare the entire APA bonkers, and rewrite the DSM-IV to diagnose
all thoughts and behaviors besides his as "mental disorders." Or doesn>t it
work that way; maybe it>s sort of democratic with majority rule, or perhaps
there>s a hierarchy with a psychiatric pope or something who outranks Dr. Phil
and makes sure official dogma is upheld? |
