I have not been able to confirm the above claim about Microsoft
forbidding vendors from writing XP drivers, but I so know that
Microsoft has been forcing vendors to put "[company name]

You can subscribe to a third party NSP, which will give you an account
name and password that you put into your newsreader/browser and access

NSPs, but they use your IP address (and check with an authorization
server at your ISP) to determine whether you need to go through the
verification process or not.

But it does still happen that armed citizens shoot, wounding or killing,
someone threatening them. For a very recent example, see:

The armed citizen will not be charged with a crime.

The thief was fortunate. He was only shot in the hand with bird-shot
pellets. Had it been my gun, he would have been shot somewhere mid-body
with a .357 slug.

This is incorrect. You talk of the "rights" of these prisoners.
"Rights" for people occur when they are in a State of Society with
each other (at peace, basically), but this is decidely not the case.

Well, I believe in certain "human rights," even for people who, yes, are out
to kill you. After all, the U.S. constitution claims our basic rights come
from our "creator," not from man, right?
Um, it does not work that way and is essentially non sequitur -- the
constitution is referring to people living (in peace) under the rule-
of-law, which quite explicitly is not the case for a state of war (or
of nature).
I>m not suggesting the folks in Gitmo should have all the same rights a
regular U.S. citizen would, of course.
They have _no rights_ (none, zip, nada), as a state of war/conflict/
nature persists. Any rights they may have had were forgone the moment
they became part of an aggression. Really, they could be executed at
any time, and no rights would be violated because they do not have
any. Now the basic reason for the sections of the Geneva Convention
calling for humane treatment of prisoners is because it is widely
recognized that the foot soldier is usually nothing more than a pawn
in a war of titans. It is more or less a recognition that hostilities
will end sometime, and "if you want your guys back in decent shape,
then you better give our guys back in decent shape." But note "humane
treatment" says nothing itself about human rights. Humane treatment
is something you can give to an animal, and an animal has no (human)
rights. The rank of a prisoner is frankly not above that of an
animal, as the prisoner was a force of nature threatening survival,
not a "peaceful member" of the _wider_ population living under a rule-
of-law (peaceful interpersonal conduct).
As a matter of survival, the aggressed can take _any_ action action
against the aggressor within their power to ensure their survival.
They can take this action for as long as the State of Nature exists.

So why not just nuke Iraq and get it over with? Far cheaper than this
seemingly-endless war we>re fighting over there.
Where did that come out of? No, "collateral damage" is not
acceptable. The parties (aggressor and aggressee, regardless of the
assignment) must confine the use of violent force to themselves, or
they face justified counterforce against them by these third parties
that were "caught in the crossfire," regardless if the party causing
the collateral damage was initially the party aggressed against. I
mean, causing collateral damage can broaden the state of nature/war
across even greater populations.
Since Al-Qaeda has not
denounced their attack, surrendered, or even so much as said they will
permanently end hostilities, a State of Nature between Al-Qaeda and
the USA still exists.

Al-Qaeda is a rather loosely organized entity that>s specifically modeled that
way so that it is pretty much impossible for them to ever be "cleanly"
defeated. This is just like, say, Napster vs. Gnutella compared to WW II vs.
the 2nd Iraqi war here: The new guys (Gnutella, Al-Qaeda) learned from the old
guys that, if you distribute yourself widely enough, it>s impossible to ever
be shut down.
If that is the case, and the aggressive intentions of Al-Qaeda
continue, then the captured associates of Al-Qaeda do not recover any
human rights and they may be imprisoned indefinitely by the US. This
is the nature of an ongoing state of nature/war. It always has been.
Like I said, these prisoners don>t get to play a cheap legal trick
just cuz they decided to fight unconventionally.
This is for the rather obvious reason
that if released, they would/could simply re-enlist and again threaten
the survival of the aggressed.

I>m all for the immediate death penalty of any enemy combatant who>s found to
have re-enlisted.
They have no rights, and didn>t the moment they became part of an
aggression. "You" can kill them or imprison them, whatever "you"
want, because they don>t have the rights of a human being from the
perspective of the other side.
I have to get going so I don>t have time to properly respond to the rest of
your comments, but I do appreciate your taking the time to write them, even
though I don>t agree with all of them.
This is all rudimentary "State of Nature" and "State of Society"
stuff. Granted, you can get all sorts of perversions of these
fundamentals, including interpretations from government and legal
"experts." Don>t count on court rulings and legislation to get it
right. Most lawyers suck. And then they become judges or legislators
(politicians).

If some living thing threatens your survival, you can justifiably kill
it. If human, the attacker forgoes consideration as a full member of
a rule-of-law society/population (and its protections) the moment they
engage in the life-threatening action.

Shoot 'em on the field I say, shoot 'em on the field ;-)

Detaining them back in Iraq and having field martials there would
have solved a lot of the problem to. Bringing so many of them back
to Gitmo seems, in retrospect, to have been a strategic error.

It>s called INTERNMENT.

Heck, they have it better there than they did back in their own
country.

(BTW,many of the unlawful enemy combatants are not even from
Iraq....they are FOREIGN nationals)

How many were even captured in Iraq?

OK,many were not Afghanis, instead foreign nationals.

I suspect that those unlawful combatants captured in Iraq stay in
Iraq,under the control of Iraq.

Exactly. Iraq was brought into this discussion, as it always is, as
a red herring to support a severely sagging argument.
